OVERVIEW
These Terms of Service govern your use of the DECLARED website, products, checkout, subscriptions, and related services (the "Services"). The terms "we," "us," and "our" refer to DECLARED, distributed by BEST BUY AUTO LEASING OF NJ LLC. By using the Services or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. ELIGIBILITY AND ACCOUNTS
You must be legally capable of entering into a binding agreement and must provide accurate, current, and complete order and account information. You are responsible for maintaining the security of your account access.
2. PRODUCTS AND HEALTH INFORMATION
Review each product label, ingredient list, directions, and warnings before use. Website content is general educational information and is not medical advice or a substitute for diagnosis or treatment by a qualified professional. Dietary-supplement statements have not been evaluated by the Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease.
Product descriptions, appearance, pricing, and availability may change. We may limit or discontinue products by person, destination, or jurisdiction. Creatine Monohydrate is not currently available for shipment to New York.
3. ORDERS, PRICING, AND PAYMENT
An order is an offer to purchase and is accepted when we confirm acceptance. We may refuse, limit, or cancel an order because of suspected fraud, inventory limits, incorrect information, legal restrictions, or an obvious pricing or listing error. If a paid order is canceled, the applicable amount will be refunded. Prices shown before checkout exclude shipping and applicable taxes unless stated otherwise.
4. SUBSCRIPTIONS
Eligible products may be offered as recurring subscriptions. The frequency, renewal price, discount, and cancellation terms are shown before checkout. By starting a subscription, you authorize recurring charges until canceled. You may cancel before the next order is processed using the Manage subscription link in your customer account or order emails. Cancellation stops future renewals but does not cancel an order already processed. There is no subscription cancellation fee. 5. SHIPPING, RETURNS, AND REFUNDS
Delivery times are estimates, not guarantees. Orders are governed by our Shipping & Returns Policy. Because supplements are ingestible products, purchases are final sale except as described in that policy or where applicable law provides otherwise.
6. OWNERSHIP AND ACCEPTABLE USE
The DECLARED name, visual identity, site design, writing, graphics, and other original materials are owned by or licensed to BEST BUY AUTO LEASING OF NJ LLC. You may use the Services for personal, lawful shopping and informational purposes. You may not interfere with the Services, attempt unauthorized access, misuse content, introduce malicious code, scrape the Services contrary to our instructions, or use the Services for unlawful or fraudulent activity.
7. THIRD-PARTY SERVICES AND SHOPIFY
The Services may use third-party providers and links. Review third-party terms before using them. DECLARED is powered by Shopify, which enables us to provide the Services, but sales are made directly with DECLARED. Shopify is not responsible for products sold by DECLARED or for the transaction between you and DECLARED.
8. DISCLAIMERS AND LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Services and content are provided "as is" and "as available," without warranties beyond those that cannot legally be excluded. We do not guarantee uninterrupted or error-free access. To the fullest extent permitted by law, DECLARED and its service providers are not liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services or products. Nothing in these Terms limits rights or remedies that cannot legally be limited.
9. GOVERNING LAW AND CHANGES
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules, except where another jurisdiction's mandatory consumer law applies. We may update these Terms by posting a revised version. Material changes will be communicated where required by law.
